New Colorado Rule-Making For Tiny Homes On A Chassis

Expected Implementation Effective July 1st. 2023

Administrative Rulemaking Hearing incorporating HB22-1242 (Tiny Homes and other changes to factory built structures)

Sam Albrecht, the Director Of The Office Of Regulatory Oversight sent an update on the Colorado rule-making for tiny homes on May 2, 2023 and shared additional changes to the proposed rules.

These changes have been developed through the Technical Advisory Committee (TAC) process. The TAC is made up of 15 individuals representing local building departments, manufacturers, sellers, installers, tiny homes, organized labor, and the construction industry. These rules are being presented to the State Housing Board as required by section 24-32-33 C.R.S.

A public hearing was scheduled on May 9, 2023 for verbal testimony.

‘After the public hearing, the Building Codes & Standards Section will engage in outreach to all stakeholders (local building departments, manufacturers, registered sellers, installers, inspections, third party agencies, the tiny home community, and other interested groups) and provide information on the final rules, implementation dates (expected to be July 1, 2023), and general Q&A.

Notice Of Rule-Making

The State Housing Board will be holding a Rulemaking Hearing scheduled for May 9, 2023, at 3:00 PM. Location is 1313 Sherman Street, Room 318. This is an in-person meeting.  

Specifically, the hearing will be addressing the following: To implement House Bill 22-1242 concerning modifications to the regulations of factory-built structures signed into law by Governor Jared Polis on May 17, 2022, and in the process ensure at a minimum the following are addressed in the rules: 

  • The rules stay consistent with the changes made in law;
  • Define new terms used in the bill;
  • Modify rules to include tiny homes into adopted building codes; fees; manufacturer registration; plan review, inspection, and approval; installers instructions and registration; seller registration, enforcement and Division of Housing approval authority;
  • Establish the safety of foundation systems for tiny homes, manufactured homes, and factory built structures in areas of the state where there are no construction standards for these structures;
  • Establish manufacturers escrow requirements of down payments;
  • Clarify that local government may include wildfire risk requirements to the building design criteria;
  • Clarify the State Housing Board may consider any national or international standard in whole or part for tiny homes;
  • Clean up formatting, citations, update language, remove unnecessary language, etc.

On 5/2/2023, the Technical Advisory Committee met to consider an additional 9 rules to be submitted to the State Housing Board at the public hearing on 5/9/2023. If you have any comments on these nine rules, please send an email to sam.albrecht@state.co.us no later than 5:00 PM on 5/7/2023. Bill Summary

Colorado law regulates the manufacturers, sellers, and installers of manufactured homes. This regulation includes requirements for the installation of manufactured homes, contract and disclosure requirements, and the registration, escrow, reimbursement, bonding, and inspections of the manufacturers, installers, and sellers. In addition, the state housing board (board) sets standards for the proper manufacture and installation of manufactured homes. The board consults with an advisory committee when promulgating rules.

The act adds tiny homes, which are typically manufactured, to this regulation on substantially similar terms. This includes adding 2 representatives of the tiny home industry to the advisory committee. The board is given the duty to regulate foundations for manufactured homes, tiny homes, and factory-built structures where no construction standards otherwise exist. Manufacturers are required to meet bonding and escrow requirements, and standards are set for payment from the bond or escrow account.
